In total, the former HOPE Clinic employees now face a combined 59 counts of various charges, including conspiracy to distribute oxycodone and money laundering, according to the indictment handed up Nov. The new indictment contains 10 fewer charges than the first indictment filed against the defendants in U. Even though there are fewer charges against the former owners, doctors and some staff at the former clinics, the nature of the allegations against them remains the same in the new indictment.

The only new charges in the indictment accuse Mark T. Radcliffe and his son, Joshua Radcliffe, of using firearms while operating the alleged pill mill. The indictment alleges that those involved distributed oxycodone and other Schedule II controlled substances outside of their legitimate and intended medical purposes between November and June James Blume Jr.

Radcliffe are accused of operating the clinic as a cash-based business and refusing to accept insurance for reimbursement for services and medications provided at the clinic.

Radcliffe was the practice manager at the HOPE Clinic, per a physician practice management agreement he entered with Blume, Stuart said. The physicians working at the clinics prescribed thousands of pills to patients who they had reason to believe were drug addicts, according to the indictment. The defendants additionally are charged as follows in the indictment:. James H. Blume Jr.

Radcliffe: one count of conspiracy to distribute oxycodone, three counts of maintaining a drug involved premises, one count of conspiracy to use firearms in a drug trafficking crime. Joshua Radcliffe: one count each of conspiracy to distribute oxycodone, maintaining a drug involved premises, and conspiracy to use firearms in a drug trafficking crime. Sanjay Mehta: six counts of conspiracy to distribute oxycodone, one count of distributing oxycodone and methadone causing death, one count of distributing oxycodone causing death.

Attorney Mike Stuart said. Roswell Tempest Lowry, 85, pleaded guilty to interstate travel in aid of a racketeering enterprise. Investigators say Lowry was recruited to work at the Charleston pain clinic and would travel to the state when he worked. Despite a number of concerns Lowry had, including patients not being properly evaluated, sloppy medical records and patients only paying in cash, he admitted that he continued to prescribe narcotics.

Federal prosecutors say Lowry would get a bonus on top of his hourly wage -- based on the number of paying customers at the clinic. A former Parkersburg doctor could face up to five years in prison after pleading guilty in connection with an alleged pill mill operation.

Paul W. Burke, 68, pleaded guilty to conspiracy to distribute controlled substances not for legitimate medical purposes in the usual course of professional medical practice and beyond the bounds of medical practice. Burke worked at the HOPE Clinic in Charleston and was named in a count indictment against the owners, managers, and physicians associated with the clinic.

Investigators say Burke admitted that the owner of the clinic recruited him to work there, despite the fact that Burke was an emergency room doctor and had little experience in dealing with chronic pain patients. He also admitted that he often received a bonus on top of his hourly pay that was clearly based on the number of paying customers at the Clinic.
